Stages Of A Criminal Case

PREARREST AND PRECHARGING REPRESENTATION. Often a person will know of a potential criminal charge before he or she is actually arrested and charged with a crime. In many cases, law enforcement agents will contact a suspect as part of a criminal investigation. In those circumstances, Escobar, Michaels & Associates’ criminal lawyers assist clients by speaking with government investigators, meeting with prosecutors and conducting our own thorough investigation in an effort to prevent charges from being filed. In many situations, Escobar, Michaels & Associates can prevent a client from being charged or can persuade the government to file less severe charges. In cases where the charge is pending, but the client has not been arrested, Escobar, Michaels & Associates can arrange for the quick and convenient surrender of the client and secure an ROR (release on recognizance) or a reasonable bond in advance. The benefit to the client is in having one of Florida’s top defense firms as a shield and advocate throughout the investigative process.

GRAND JURY INVESTIGATIONS. Escobar, Michaels & Associates represents individual and corporate entities in pending grand jury investigations.

EMERGENCY BOND HEARINGS. Upon an arrest, the most urgent goal is to obtain the release of a client. In most circumstances, the accused has a right to a reasonable bond and an emergency bond hearing. Escobar, Michaels & Associates can quickly obtain a bond hearing upon being retained by a client. Often, Escobar, Michaels & Associates can negotiate a stipulation from the prosecutor regarding the release of the client on reasonable conditions of bond or we can persuade the court to grant reasonable conditions of pretrial release.

ALL CRIMINAL MATTERS. Escobar, Michaels & Associates represents clients in criminal matters in all state and federal courts. The attorneys have litigated to jury trial hundreds of criminal cases. We have successfully represented individuals charged with first-degree murder, DUI manslaughter, racketeering, drug trafficking and possession, robbery, battery, arson, white collar crimes (theft, fraud, health care fraud, identity theft, bank fraud), sex offenses, computer-related crimes, firearms matters, and all DUI and traffic cases. Escobar, Michaels & Associates practices in state and federal courts in Florida. We also represent clients in criminal cases throughout the United States, pro hac vice.

PRETRIAL LITIGATION. Escobar, Michaels & Associates litigates criminal matters with the belief that success is achieved through prompt, intense and thorough pretrial investigation and preparation. As such, we meticulously evaluate each case by investigating the government’s witnesses and evidence and employing innovative techniques to discover the client’s best defenses. We employ experienced investigators and forensic specialists who are leaders in their fields. These investigators and forensic specialists are invaluable in preparing for cross-examination of government witnesses, as well as in presenting exculpatory evidence.

APPEALS AND POST-CONVICTION MATTERS. Escobar, Michaels & Associates has an extensive history of representing clients in appellate, post-conviction and other matters that result from a criminal conviction. Escobar, Michaels & Associates employs attorneys with experience writing appeals (both state and federal) and arguing appeals before appellate courts. The attorneys are also well-versed in post-conviction matters under Florida Rules of Criminal Procedure 3.800 and 3.850, pertaining to illegal sentences, ineffective assistance of counsel and newly discovered evidence that may affect the case.

In post-conviction matters for illegal sentences, ineffective assistance of counsel and newly discovered evidence, Escobar, Michaels & Associates offers a unique service in reviewing cases for any potential claims that may entitle clients to post-conviction relief. The firm charges a fee to thoroughly review the case and issue a written opinion for the client outlining all viable claims and the likelihood of success. The review allows the client to thoroughly evaluate the expenditure of attorney’s fees and the relative strengths of the case before deciding on a strategy for pursuing potential post-conviction matters.
