Proving a driver is impaired with only a BAC level as evidence

A night out with friends in Tampa can quickly turn into a nightmare if you are driving a car and get pulled over by police for suspicion of driving while intoxicated. Florida has some of the toughest drunk driving laws in the country with penalties that may include imprisonment, fines and license suspension for a first offense. U.S. Supreme Court declines to hear FL cellphone warrant case

We have posted on the topic of whether and how the government can use cell phone location information as a means of tracking your location, most recently in connection with the use by law enforcement of "Stingray" devices. Now in its refusal to hear an appeal of a Florida criminal conviction the U.S. Supreme Court has effectively held that it is not necessary for police to obtain a warrant to obtain that information.
