Florida man charged in death of his son

On Behalf of | Apr 24, 2014 | Felonies

A Florida man was arrested recently for third-degree murder and child neglect with great bodily harm. This is after he allegedly suffocated his baby son for distracting him from his X-Box games.

The man was playing X-Box games online, and according to the arrest affidavit, the man’s son was crying and wailing uncontrollably. The man became annoyed. To stop the baby from crying, he covered the boy’s mouth and nose with his hand for as long as four minutes. When the baby seemed lethargic, the man put him in his playpen and smothered him completely with several layers of bedding in a way that made it impossible for the child to breathe.

It was not until five hours later that the 24-year-old checked on his son. When he did, he discovered that the child was not breathing and had turned blue.

It is not clear yet how this man will plead when the case goes to court, or whether he will have a criminal trial. The case is still in its early stages, and medical examiners have yet to verify the cause of death. It is also not clear whether the man has a criminal defense attorney representing him. However, it appears that he is not a first-time offender. He has a record of previous offenses committed out-of-state which include trespassing and rape.

Third-degree murder is defined as an unplanned killing. It is less serious than first- and second-degree murder, but it is still an extremely serious felony offense. Anyone arrested on murder charges should seek the assistance of an experienced criminal defense attorney immediately.
