The manufacturing process involves the combining of natural herbs, usually damiana or marshmallow leaves and a chemical compound. JWH-018, AM-2201 and UR-144 are some of the most commonly used chemical compounds.

On March 1, 2011, the Drug Enforcement Administration used its temporary scheduling authority to place synthetic cannabinoids on Schedule I of the Controlled Substances Act. Those synthetic cannabinoids are JWH-018; JWH-073; JWH-200 and CP47. On July 9, 2012, President Obama signed into law the Synthetic Drug Control Act of 2012, which added the compound AM-2201. The state of Florida has similar laws banning both JWH-018 and AM-2201.

The importance of the federal legislation and the DEA’s temporary scheduling power is twofold. Firstly, the named compounds are a Schedule I controlled substance, which means they are treated like heroin, cocaine or marijuana. Secondly, compounds that are “substantially similar” in chemical structure and pharmacological effect are potentially illegal under the federal Analogue Enforcement Act. The term “substantially similar” is not defined by the Act. The question of whether or not a compound is an analog is determined on a case-by-case basis. A battle of experts.
